COMMENTARY AND OPINION. . . . | WHEN YARA MET FADI: GAZANS HELP COUPLE PICK UP THE PIECES AFTER ISRAELI STRIKE
By Ali Adam
“We thought our love was hopeless, but we continued nonetheless,” Fadi al-Ghazali told Al-Monitor, standing in his heavily damaged apartment in the Sheikh Radwan district of Gaza City. As he and his mother went about clearing the rubble in their apartment from the Nov. 12 Israeli airstrike, on the wall hung a wedding gown, an object that has dominated social media as the symbol of the touching love story of Fadi and Yara, a young woman from Syria. [. . . .] In late September, the Egyptian Embassy finally contacted Yara to tell her that she had been granted permission to enter Gaza through the Rafah crossing. After three years of trying, Yara finally arrived in Gaza, on Nov. 8. As Fadi describes it, they can’t remember what their first conversations were about, because when they first met in person, they both “blacked out” from extreme joy and excitement. More . . .

|ISRAEL’S DEFIANCE OF HISTORY, MORALITY AND LAW
Jeremy Salt
No state established on land seized by force from the people living on that land can claim moral legitimacy and a ‘right’ to exist. ____A purported ‘right’ to exist is not central to the existence of states anyway, let alone colonial settler states established amidst the wreckage of the genuine rights of another people. [. . . .] Israel understands this as well as anyone. It makes a lot of noise about its right to exist and its legitimacy but this is bluster. It knows why it exists and why it believes it will continue to exist. It has a strong military. It has nuclear weapons. It can destroy anyone who threatens to destroy it. These are the constituent elements of its existence, not morality and the ‘rights’ of which it endlessly talks. More . . .

“RETURNING,” BY MAJID ABU GHOUSH
the woman was dragging her feet
and what remained of her children
towards what remained of her home
towards what remained
of the sea
towards what remained
of the heart
towards what remained of the heart
she raised her hand softly
wiped a tear which rolled down her cheek
and smiled when the beautiful one
she met on the way asked her:
why are you going back?
to water the jasmine tree
to shade the names of the martyrs

EXPLOITING GAZA TOPS THE UN’S HUMANITARIAN AGENDA
What would prompt the UN to assert, without reservations or calculated statements, that Gaza has collapsed in terms of humanitarian necessities? The celebrated English historian Edward Gibbon, writing in 1776, noted that ‘Phoenicia and Palestine will forever live in the [collective] memory of mankind’. . . Palestine is the collective watan (homeland) of the Palestinian people —the indigenous people of historic Palestine. The Palestinian people have a multi-religious and multicultural ancient heritage and a multi-layered identity deeply rooted in ancient history. Palestinians often speak of Biladuna Filastin: ‘Our Country, Palestine’ (colloquially: Bladna Falastin). The country of Palestine as a distinct political geography-with its own distinct and diverse traditions and a mélange of styles —is deeply rooted in the indigenous psyche and consciousness; the toponym (place-name) of Palestine is deeply rooted in the ancient past from the Late Bronze Age onwards. . . . For a millennium and a half of Classical Antiquity and Byzantine Christianity as well as under Islam in the Middle Ages the term Palestine also acquired official administrative status.
[. . . .] For over 1200 years the name Palestine was used most commonly, consistently and continuously throughout Classical Antiquity, from the highlight of classical Athenian civilisation . . . [until] the occupation of Palestine by the Muslim armies in 637 AD.
___To substitute the vague and semi-mythical term Cana’an for the real historical and official toponym Palaestina for a spectacular classical period lasting over one millennium would be tantamount to the elimination of the actual history of this important region . . . [and] eliminate the possibility of any real historical knowledge of one of the most important periods in the ancient history of the region, namely: early Christianity and Byzantine greater Palaestina. Greek-speaking Byzantine Christianity in Palestine began in the reign of the Roman Emperor Constantine the Great (306—337 AD) and lasted until the beginning of Islamic rule in Palestine in 637 AD.
[. . . .] Furthermore, when referring to the ancient history of this region modern European scholarship (and even early Zionist scholarly societies such as the ‘Jewish Palestine Exploration Society’, founded in 1914) universally and unanimously talk about ‘Palestine’, even when referring to Jewish history. The daily report highlights the violations behind Israeli home demolitions and demolition threats in the occupied Palestinian territory, the confiscation and razing of lands, the uprooting and destruction of fruit trees, the expansion of settlements and erection of outposts, the brutality of the Israeli Occupation Army, the Israeli settlers violence against Palestinian civilians and properties, the erection of checkpoints, the construction of the Israeli segregation wall and the issuance of military orders for the various Israeli purposes. [. . . .] Since the rise of the Zionist settler movement in the late nineteenth century, and especially since the establishment of Israel in 1948, the struggle over toponymic memory and the renaming of sites has developed as an integral part of the political conflict in Palestine. The indigenous Palestinians have insisted on their own comprehensive set of Arabic place names through which they see their own social memory and deep-rootedness in the land of Palestine. On the other hand, since the ethnic cleansing of the 1948 Nakba and the creation of the Israeli state . . . the Israeli army and Israeli state have sought to rename systematically Palestinian Arabic place names, claiming priority in chronology and using modern archaeology, map-making, and place names as their proofs of Jewish roots in ‘the land of Israel’. In Israel the significance of place names lies in their potential to legitimize ‘historical claims’ asserted by the Zionist settler-colonial movement.
[. . . .] The social and cultural importance of toponymic memory and geographical rendering of sites and terms in historical writing is evident in many histories from antiquity, medieval and modern Palestine. One classical example of listing place-nations of ancient Palestine in ‘Histories’ (or The History, 1987) of Herodotus, written from the 450s to the 420s BC. Herodotus is believed to have visited Palestine in the fifth decade of the fifth century B.C. The ‘Father of History’ refers to ‘Palaistine’, Syria, or simply ‘Palaistine’ five times, an area comprising the region between Phoenicia and Egypt. . . . Although Herodotus’s Histories is now considered a founding work of history in Western literature, and serve as a key record of the ancient traditions, politics, geography, and clashes of various powers that were known in Greece, Western Asia and North Africa, when it comes to Palestine and toponymic memory Western Christian writing relies not on Herodotus’ Histories but on the myth-narratives of the Bible. Interestingly however the Greek toponym for Palestine and Ascalan were preserved in indigenous Palestinian Arab tradition and by medieval Arab historians and travellers . . . . SOURCE. ❸ ANALYSIS: PESSOPTIMISTIC REFLECTIONS FROM BESIEGED GAZA Mondoweiss
Haidar Eid
Oct. 20, 2017 One cannot understand the deadly, medieval siege imposed on Gaza apart from Israel’s settler-colonialism in Palestine. The horror inflicted on Gaza is, in fact, rooted in the political fragmentation caused by Apartheid Israel, reinforced by the Oslo authority, and sparked by factional struggles over access to power in a Bantustan turned into a concentration camp.
___The rationale behind this genocidal blockade imposed by Apartheid Israel, and supported by a complicit ME Quartet is that we, 2 million Gazans, are expected to recognize Israel’s right to exist on our ethnically cleansed villages from where we were expelled in 1948 and renounce our resistance as a form of violence. This is how this Crime of Collective Punishment is justified! The international community is basically telling us that we must collaborate with the occupiers in order to be accepted, that we must normalize apartheid and settler colonialism. If we don’t do that, we are doomed then and must pay a heavy price with the lives of our children. MORE . . . .

___Police used clubs and tear gas to disperse the worshipers. A number of people suffered from gas inhalation and beating and were treated on location. Police arrested two Palestinians.
___Worshipers have been holding the prayers outside Al-Aqsa Mosque compound since Sunday after Israel erected metal detectors at the gates to the compound and demanded that people had to go through them first before entering the compound. Muslim leaders have rejected this new measure and vowed to fight it. They also called on people not to enter Al-Aqsa going through the metal detectors. Military wings of various political factions in the besieged Gaza Strip warned Israel against continuing its restrictive policies at Al-Aqsa Mosque compound in occupied East Jerusalem during a press conference on Tuesday, saying that Israel’s “offensive” on Al-Aqsa represents a “spark that will explode in the region.”
___“We will have our strong and supreme word if Zionist plans against Al-Aqsa continue,” the groups warned in the press conference. “We will not allow our enemy to invade our Al-Aqsa, our holy sites, and our people in Jerusalem.”

[. . . .] Since its founding, Hamas has proved to be a flexible and dynamic organization. At times reformist, at others militant, its essential character as a sociopolitical movement has been difficult to define in any certain terms. Perhaps the movement’s shifting positions on the question of religion and nationalism. While some scholars have prioritized Hamas’s religious dimensions and thus located it within broader trends of what has been called ‘political Islam’ or ‘Islamism’, I believe there are several factors that suggest the organization’s religious hue is insufficient for fully negating its nationalist character. First, while Hamas employs a discourse saturated with religious references to the Quran, hadith and the concept of jihad, the target audience of this discourse is nonetheless confined to the Palestinian people. Put simply, Hamas is not speaking to the Muslim umma; rather, it is speaking particularly to Palestinian Muslims and more generally to the Palestinian nation. It wants to put Muslim Palestinians at the forefront of the national movement. Palestinian Muslims thus represent a vanguard of the nation who, in virtue of their invented religious tradition and identification, have a critical role to play in the liberation of Palestine from Israel. In pragmatic terms, Hamas has also confined its efforts to the geography of the national context.
[. . . .] Hamas’s reformist and military approach to the struggle against Israel has also been defined within the limits of the Palestinian territories. It does not work for a transnational reformation of the Muslim world in preparation for a global jihad against Israel and its allies. Rather, it works through a diverse network of charitable institutions in Palestine to support all Palestinians while promoting an Islamic reformation within Palestinian society. . . . Hamas locates the Islamic reformation of Palestinian society within a greater program of national liberation. Thus turning Palestinian Muslims toward a more pious (Islamic) lifestyle is inextricably linked to the struggle against Israeli occupation and the Palestinian nationalist cause. . . . In this sense, religious reformation is understood as an essential step toward succeeding in the national struggle where secular organizations have failed. Finally, even the very distinction between what is definitively Islamic and what is definitively national about Hamas remains unclear. An analysis of Hamas’s discourse suggests that it is appropriating religious concepts in Islam for nationalist purposes.
[. . . .] To the extent that religious ideology can be distinguished from nationalism in Hamas’s discourse and practice, it is clear that neither is sufficient for trumping the other [ . . . .] SOURCE . . .

wiped a tear which rolled down her cheek
and smiled when the beautiful one

___The Abu Khdeir family had presented the petition to the Israeli courts demanding that Yosef Haim Ben-David and two minors, who were convicted of kidnapping and burning the Palestinian teenager alive three years ago, have their homes demolished, in line with an official Israeli policy carried out overwhelmingly against Palestinians who have killed Israelis.

(The report has been removed from the UN website. It is available at link below.) [. . . .] Since 1967, Palestinians as a people have lived in what the report refers to as four “domains”, in which the fragments of the Palestinian population are ostensibly treated differently but share in common the racial oppression that results from the apartheid regime. Those domains are: Civil law, with special restrictions, governing Palestinians who live as citizens of Israel; Permanent residency law governing Palestinians living in the city of Jerusalem; Military law governing Palestinians, including those in refugee camps, living since 1967 under conditions of belligerent occupation in the West Bank and Gaza Strip; Policy to preclude the return of Palestinians, whether refugees or exiles, living outside territory under Israel’s control. [. . . .] This report finds that, taken together, the four domains constitute one comprehensive regime developed for the purpose of ensuring the enduring domination over non-Jews in all land exclusively under Israeli control in whatever category. To some degree, the differences in treatment accorded to Palestinians have been provisionally treated as valid by the United Nations, in the absence of an assessment of whether they constitute a form of apartheid. In the light of this report’s findings, this long-standing fragmented international approach may require review. [. . . .] The report concludes that the weight of the evidence supports beyond a reasonable doubt the proposition that Israel is guilty of imposing an apartheid regime on the Palestinian people, which amounts to the commission of a crime against humanity, the prohibition of which is considered jus cogens in international customary law. The international community, especially the United Nations and its agencies, and Member States, have a legal obligation to act within the limits of their capabilities to prevent and punish instances of apartheid that are responsibly brought to their attention . . . . ❸ RESIDENCY REVOCATION: ISRAEL’S FORCIBLE TRANSFER OF PALESTINIANS FROM JERUSALEM Al-Shabaka: The Palestinian Policy Network
July 3, 2017. Under international law, East Jerusalem is considered an occupied territory and the de facto annexation of the city by the Israeli government is considered illegal. Throughout its occupation, Israel has enacted discriminatory laws and policies to diminish the presence of the Palestinian population in East Jerusalem. By granting Palestinians a “permanent” residency status to live in Jerusalem, entry into and residency in Jerusalem becomes a revocable privilege, instead of an inherent right.
___The second infographic focuses on the unlawful Israeli policy of residency revocation targeting Palestinians from Jerusalem. The revocation of permanent residency status is the most direct tool used to forcibly transfer Palestinians from occupied East Jerusalem, so that a Jewish-Israeli majority can be maintained in the city. 1 Since 1967, Israel created and consistently expanded the criteria for revoking the residency status of Palestinians, leading to the revocation of the residency rights of more than 14,500 Palestinians from Jerusalem to date. [. . . .] However, on closer look, apartheid in Israel is as constitutionally inbuilt as it was in South Africa and structurally limits, directly or indirectly, the ambit of possible egalitarian reforms. Central governmental investment turns out to be inherently biased in favour of the country’s Jewish population, and official property law regimes and land policies push towards the ‘Judaisation’ of the land, meaning the transfer to Jewish citizens or institutions of lands expropriated from non-Jewish Arab citizens and/or institutions while discouraging, or even actually forbidding, non-Jewish Arabs from taking up residence in Jewish areas. . . . ‘Emergency’ Regulations caused many cases of uprootedness and internal displacements. Many housing projects in new development towns are not open to non-Jewish Arabs. Arab municipalities are given far less investment than their Jewish counterparts. Many welfare benefits such as higher education places, preferential loans, have purposely been made conditional upon army service so as to exclude non-Jewish Arabs who are generally barred from serving, and, of course, cannot be expected to have any great wish to serve, in the Israeli Defense Forces (IDF). ‘Non-Jewish Arab second class ‘citizens’ are not entitled to compete for university scholarships that are given by the Jewish Agency. . . Tax benefits are open to ‘returning’ Israeli Jews or to Israeli Jewish citizens who have spent a long time abroad thus tempting them to emigrate to Israel, while these are not open to non-Jewish Arabs. Sept. 2, 2016
Israel’s Supreme Court ruled on Thursday that an illegal Israeli settlement outpost in the occupied West Bank district of Bethlehem be demolished by March 2018, sparking condemnation from right-wing Israeli parliament members who blamed the decision on left-wing groups aiming to “exploit the judicial system” for the benefit of a minority.
___The court ordered the removal of 17 homes, comprising of some 40 Israeli families, in the Israeli settler outpost of Derech HaAvot established in 2001 near the Gush Etzion settlement bloc after ruling that the outpost was built on privately held Palestinian land, according to a statement released by Israeli settlement watchdog Peace Now.
___ The Jerusalem Post reported that the outpost was established with 300,000 shekels ($79,562) from the Israeli Ministry of Construction and Housing. Soon after its establishment, the outpost was challenged in the courts by Palestinians from the town al-Khader who claimed they owned the land. MORE . . .

[Three] mechanisms stabilizing the Israeli-Palestinian conflict and avoiding the adoption of peace policies. . . The third mechanism relates to the institutionalization of a bureaucratic inertia that maintains and feeds the occupation regardless of declared policies. This mechanism acts at a governmental level when, for example, a senior clerk in the Ministry of Justice announces a regulation that the government does not have to prove ownership of lands in cases of land disputes. Instead, the Palestinians who claim ownership have to prove their ownership of the land in question, and, as a result, this regulation means that many Palestinians lost their lands due to the settlement process. . . . The military was also forced to serve the settlers’ interests by guarding unauthorized settlements that were ordered to evacuate based on the law and Supreme Court decisions. Finally, the settlers’ council represents a population of an estimated 500,000 settlers who have relatives and ideological support among the religious sections, allowing the movement to become a powerful lobby in Israeli politics. The fact that they are more motivated and better organized than other political lobbies in Israel makes them even more powerful.
___ . . . the occupation became a fundamental catalyst of far-reaching impacts on Israeli society. The state of Israel becomes more Jewish and less democratic in the delicate balance between these two aspects. Jewishness is defined in a combination of religious and nationalist terms, promoting a particularistic identity that turns its back on the Hebrew identity that emphasized universal and humanistic values. By defining the OPT as the core of the Jewish state and identity, the new Israel antagonizes the Palestinians, the Arab world and, indirectly, Western societies, which in turn, strengthen particularistic aspects of Israel’s identity bringing new life to slogans such as “People who live unto themselves.”
